The Greek law contains no explicit provisions regarding the “expectancy right”. The present study discusses at first the conceptual definition and the methodological foundation of the expectancy right (first part) and continues with its use in several specific issues (second part). The examples that are examined cover the whole private law and include the main cases where an expectancy right is recognised: conditional or time rights (e.g. conditional receivables, retention-of-title clauses, fiduciary transfers, testamentary trusts), the option of the lessee under a registered financing leasing, the already filed but not yet registered trademark etc. Efforts are made to depict common characteristics of the specific aspects of this kind of rights in order to construct a coherent theoretical approach, so much needed by such an un-regulated legal notion. |
